**Hyderabad, January 17, 2025** – The Telangana High Court has dismissed a 64-year-old civil suit concerning the partition of 24 Maktha properties, ruling that the claims made by the parties involved are unsustainable. The case, originating in 1953 with a suit filed by Sultana Jahan Begum, involved a complex history of legal proceedings, including a 1959 preliminary decree and subsequent reports from court-appointed commissioners.

The court, comprising Chief Justice Alok Aradhe and Justice N.V. Shravan Kumar, determined that no land remained available for partition. A key finding highlighted that 25 properties, initially included in the dispute, were identified as Maktha lands – subject to ongoing litigation within the Revenue department – and had never been restored or released to the claimant, Asman Jahi Paigah. Therefore, the court concluded that claims based on the 1959 preliminary decree were invalid.

The court’s decision followed a 2022 appointment of a new Receiver-cum-Commissioner, whose 2023 report traced the origin of the litigation to the execution of Assignment Deeds and further confirmed that the 25 properties remained unavailable for partition. The court ordered the distribution of any outstanding income, compensation, or sale proceeds from the properties only upon their eventual restoration or release.
