The controversy stemmed from a December 9th government order transferring seven DMOs, including Dr. N. Rajendran of Kozhikode, who challenged the transfer in the Kerala Administrative Tribunal (KAT).
Dr. Rajendran’s appeal, along with those of two other affected officials, caused confusion within the Health Department. Despite Dr. Asha Devi officially taking charge on December 10th, Dr. Rajendran returned to his post on December 13th, citing a favorable KAT order. This led to a highly unusual situation where both officials simultaneously occupied the DMO office.
The situation was resolved after the KAT clarified its position on December 19th. While acknowledging the December 9th order violated principles of natural justice, the tribunal stated it wasn’t interfering with the transfers as not all affected officials had approached them. The KAT further indicated that individual claims would be considered after a hearing, with fresh orders to be issued within a month.
