NEW DELHI — The Supreme Court of India today sharply criticized authorities in Delhi for their delayed implementation of air pollution control measures, as the city’s air quality plummeted to “severe-plus” levels. The court specifically targeted the slow response in enacting Stage 4 restrictions under the Graded Response Action Plan (GRAP), a four-stage system designed to combat Delhi’s notorious air pollution.
The court noted a three-day delay in implementing GRAP Stage 3, even after the Air Quality Index (AQI) surpassed the 300 mark. Justices A.S. Oka and A.G. Masih questioned the wait-and-see approach, stating that restrictions should be implemented proactively, not reactively. The court issued a strong order mandating that Stage 4 restrictions remain in effect, even if the AQI drops below 300, without the court’s explicit permission. This unprecedented directive underscores the court’s concern over the authorities’ inaction.
The judges also criticized the reliance on weather predictions for AQI improvement, instructing authorities to anticipate high AQI levels and implement preventative measures accordingly. The Delhi government has been ordered to submit an affidavit detailing the implementation of emergency response plans.
The Supreme Court further ruled that the CAQM’s sub-committee employed an incorrect approach in implementing GRAP 3 and 4, emphasizing the need for anticipatory action rather than a reactive response. All states in the National Capital Region have been directed to enforce GRAP 4 restrictions and establish monitoring committees to ensure strict compliance. A compliance affidavit is required from all state and central governments by Thursday.
GRAP Stage 4, currently in effect, includes the ban of commercial vehicles registered outside Delhi unless they are electric, CNG, or meet BS-VI emission standards. Further restrictions, such as suspending in-person classes for older students, remain under consideration.
