**Fort Lauderdale, FL** – A Texas woman is suing Broward County Sheriff’s Office after being wrongfully arrested and spending Christmas Day in jail. Jennifer Heath Box was mistakenly identified as a woman wanted for felony child endangerment in Texas. The arrest warrant listed Box’s name, but the woman sought by authorities had a different middle and last name, and was 23 years younger with different hair, eye, and skin color.
Box was detained while disembarking a cruise ship on Christmas Eve, 2022. She had been planning to fly home to Houston to spend Christmas with her family, including her son, a US Marine about to leave for a three-year deployment. Instead, Box was forced to spend Christmas Day in jail before being released on December 27th.
“I’ve never done anything to where I would find myself on the other side of bars,” Box stated at a press conference. “It was really difficult for me because I had to call my kids and tell them that I wasn’t going to be there.”
Box’s attorney, Jared McClain, argues that Broward County Sheriff’s Office failed to recognize numerous discrepancies between Box and the woman on the warrant. “At none of those red flags did anyone in Broward County stop and say, ‘Maybe we’re making a mistake here. Maybe we shouldn’t put this woman in jail over Christmas,'” McClain said.
The Broward County Sheriff’s Office claims they were alerted to Box’s alleged warrant by U.S. Customs and Border Patrol, and that the arrest was based on information from the Harris County Sheriff’s Office. However, they maintain that the Texas authorities ultimately bear responsibility for the error.
Box’s lawsuit alleges that the wrongful arrest was “humiliating and degrading,” causing her significant emotional distress. The case highlights the importance of thorough verification and due diligence when executing arrest warrants, particularly in situations where innocent individuals are at risk of wrongful detention.
