Bombay High Court Slams Maharashtra Government Over Illegal Navi Mumbai Constructions
Mumbai, November 19, 2025 – The Bombay High Court has sharply criticized the Maharashtra government for its inaction regarding widespread illegal construction in Navi Mumbai. In an order made public today, the court stated the government “cannot remain a passive spectator” while middle-class homebuyers bear the brunt of systemic failures.
The ruling came as the court dismissed a 2019 Public Interest Litigation (PIL) seeking demolition of unauthorized structures, primarily targeting the Palm Beach Residency, a luxury complex allegedly occupied without proper certifications. While acknowledging the gravity of illegal construction, the court deemed the PIL too vague and filed too late, nearly a decade after the project’s completion. The court pointed out that the environmental clearances were never challenged.
The court noted that the Navi Mumbai Municipal Corporation (NMMC) has identified over 2,100 buildings constructed without permission or in violation of approved plans, raising concerns about a potential nexus between corrupt officials and developers. Despite dismissing the PIL, the court emphasized that its decision did not excuse illegality and that the government and NMMC are free to prosecute those responsible for the violations.
The court vacated previous orders restricting the sale of properties in Palm Beach Residency, stating that buyers should not be penalized for developer misconduct. They added that the society had already paid a penalty and was granted a provisonal OC.
The court emphasized that PILs should not be used for private disputes or harassment. The court highlighted that similar directions have already been issued to NMMC to survey illegal structures, issue notices, and follow Supreme Court guidelines on demolition.
