Jonathan, who has resided in the US for nearly a decade, was detained in Houston while transiting back to Australia for a brief family matter.
Upon arrival in Houston, Jonathan was taken to a secondary inspection room, where he claims conditions were overcrowded and posters promoting diversity had been defaced. Jonathan, now couch surfing in Australia, separated from his life, partner, and work, is exploring legal options, although lawyers have warned that a challenge could be costly and time-consuming. He has been advised he can apply for a new visa but would need a waiver, a process he acknowledges is unlikely to succeed given current US immigration policies.
The Department of Homeland Security responded to an inquiry from Guardian Australia stating they could not verify or comment on the allegations. The Australian Department of Foreign Affairs and Trade will release data on consular assistance to Australians in the US at a later date.
This incident is one of several recent reports of mistreatment of foreign nationals at US borders, raising concerns about the application of immigration policies.
