WASHINGTON D.C. – President Donald Trump’s recent assertion that he is “not joking” about seeking a third term in office is facing significant constitutional obstacles. While Trump claims there are “methods” to circumvent the two-term limit enshrined in the 22nd Amendment, legal scholars overwhelmingly disagree.
The 22nd Amendment, ratified in 1951 following Franklin D. Roosevelt’s four terms, explicitly states that no person can be elected president more than twice. Trump’s suggestion of a workaround, potentially involving serving as Vice President, appears to be blocked by the 12th Amendment, which bars those ineligible for the presidency from becoming Vice President.
A Republican lawmaker, Andy Ogles, has introduced a resolution aimed at enabling a third term for a president serving non-consecutive terms, but its success is considered highly unlikely. A constitutional convention to amend the 22nd Amendment is also deemed improbable.
Trump’s comments, while previously dismissed as jokes, have spurred a reaction in betting markets. His odds of winning the 2028 election have reportedly shortened, placing him second behind current Vice President JD Vance.
