**Hyderabad, India –** The Telangana High Court has urged the state government to enact new legislation specifically addressing the management of gated communities, following concerns over rising illegal activities within these residential enclaves. The court’s recommendation stems from a petition highlighting issues such as gambling, alcohol consumption, drug use, and sexual misconduct in a Hyderabad villa community.
The court highlighted the need for stricter regulations, mandating prior approval from the Excise and Prohibition Department for alcohol consumption in community clubhouses and authorization from local police for events like DJ parties. Law enforcement agencies have been instructed to issue advisories to gated communities based on existing laws like the City Police Act, Noise Pollution Act, and Excise and Prohibition Act. The Police Commissioner has been tasked with ensuring prompt responses to complaints.
To improve reporting, the court suggested the development of a confidential reporting app for residents. The court also encouraged proactive self-regulation within communities, recommending the formation of resident sub-committees to monitor communal areas and report irregularities. These committees should include senior citizens, women, or retired individuals, and associations should create clear guidelines for clubhouse use with strict penalties for violations.
Justice B. Vijaysen Reddy noted that existing laws are insufficient to address the unique challenges faced by gated communities, necessitating specialized legislation.
