Tue Dec 31 19:17:38 UTC 2024: ## Delhi High Court Dismisses Medical Negligence Claim, Upholding Doctors’ Actions

**New Delhi, January 1, 2025** – The Delhi High Court dismissed a man’s plea seeking action against doctors for his wife’s death in 2016, ruling that dissatisfaction with care does not constitute medical negligence. The court delivered its verdict on December 20th.

The petitioner alleged medical negligence against three doctors at a private hospital, citing delays in treatment, drug overdose, and the unavailability of a senior doctor. He requested the National Medical Commission (NMC) to punish the doctors, potentially removing their names from the medical register.

While acknowledging the petitioner’s grief, the court noted that the Delhi Medical Council and NMC had already investigated the complaint. Although some shortcomings were identified in two other doctors, no action was taken against those named in the plea. The court stated it would not reassess the conclusions of expert bodies unless clear illegality or perversity was evident.

The High Court emphasized that medical negligence is determined by whether a doctor’s actions fell below the accepted standards of a reasonably competent practitioner, not simply by unmet patient expectations or timelines. The court’s decision highlights the established legal standard for proving medical negligence.
