**The Hague, Netherlands** – The International Criminal Court (ICC) has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Israeli Defense Minister Yoav Gallant, and Hamas military chief Muhammad Deif. The warrants, issued Thursday, allege war crimes and crimes against humanity, including starvation as a method of warfare and acts of murder and persecution, committed in the Gaza Strip.
The ICC’s chief prosecutor, Karim Khan, requested the warrants in May. Israel vehemently denies the allegations against Netanyahu and Gallant. The warrant for Deif, whom Israel claims to have killed in August, is notable given the circumstances.
US President Joe Biden issued a statement condemning the warrants, asserting that there is “no equivalence” between Israel and Hamas and reaffirming unwavering US support for Israel’s security.
The ICC, established in 1998 under the Rome Statute, has jurisdiction over four types of crimes: crimes against humanity, genocide, crimes of aggression, and war crimes. While it has issued 59 arrest warrants previously, including one for Russian President Vladimir Putin, the court relies on member states for enforcement. Neither Israel nor the United States is a member of the ICC.
The warrants’ enforceability remains uncertain. Experts note that Netanyahu and Gallant can likely travel freely to many countries that are not ICC member states. The ICC’s ability to secure the arrests and subsequent prosecution depends entirely on the cooperation of its member states. If the individuals do not appear before the court, legal proceedings cannot commence. The issuance of the warrants, however, represents a significant move by the ICC to hold powerful individuals accountable for alleged atrocities.
