**Kolkata, November 16, 2024** – The Calcutta High Court has established a dedicated Intellectual Property Rights (IPR) Division and Appellate Division, operational since November 4th. This move aims to expedite the resolution of IPR cases, a significant development for the region’s innovators and businesses.
Justice Soumen Sen and Justice Biswaroop Chowdhury will constitute the Division Bench, overseeing appeals and applications related to intellectual property. Two single-judge benches, led by Justice Ravi Krishan Kapur (cases from 2020 onwards) and Justice Krishna Rao (cases filed up to 2019), will also handle IPR matters.
The new division follows the publication of the IPR Division rules earlier this year. The Calcutta High Court now joins Delhi and Madras High Courts in having dedicated IPR divisions, with the Karnataka High Court also considering a similar initiative. The court’s notification stated that the new rules, titled “Intellectual Property Rights Division Rules of the High Court at Calcutta, 2023,” will govern all procedures within the newly established divisions.
Malobika Sen, a faculty member at West Bengal National University of Juridical Sciences, lauded the development. She highlighted that dedicated IPR courts allow for faster case disposal and facilitate the involvement of expert opinions in complex technical matters. The new division is expected to significantly improve the protection of intellectual property rights within West Bengal.
