**New Delhi, November 14, 2024:** The Supreme Court on Thursday dismissed a Public Interest Litigation (PIL) seeking intervention against allegedly inflammatory speeches by public figures. The court maintained that there is a distinction between hate speech and “wrong assertions” and suggested the petitioner, ‘Hindu Sena Samiti’, utilize existing legal avenues to address their grievances.
The PIL argued that these speeches, often made by politicians, threaten national unity and security by promoting divisive ideologies. The petitioners, citing recent comments by figures like Sajjan Singh Verma and Rakesh Tikait, alleged that these speeches incited unrest and potentially triggered violence.
However, the Supreme Court bench, comprising Chief Justice Sanjiv Khanna and Justice Sanjay Kumar, declined to issue notice on the petition. The bench emphasized that it was not commenting on the merits of the case but simply deemed the petition not worthy of further consideration.
The PIL had requested the court to formulate guidelines to prevent provocative rhetoric and implement penalties against individuals making inflammatory statements. It also highlighted the perceived inconsistency in the government’s enforcement of legal restrictions on such speech.
The ‘Hindu Sena Samiti’ had sought several reliefs, including the establishment of training programs for politicians to promote responsible speech. It argued that while ordinary citizens and journalists face stricter consequences for similar offenses, politicians seem to escape accountability for their potentially incendiary rhetoric.
The Supreme Court’s decision underscores the complex interplay between freedom of speech and the potential for incitement. While the court acknowledged concerns about inflammatory language, it ultimately deferred to established legal frameworks to address the issue.
