Thu Nov 07 04:21:57 UTC 2024: ## Andhra Pradesh Introduces Tougher Anti-Land Grabbing Bill
**Amaravati, November 7, 2024:** The Andhra Pradesh government has taken a significant step in combating rampant land grabbing with the introduction of the Andhra Pradesh Land Grabbing (Prohibition) Bill-2024. This new legislation aims to replace the existing 1982 Act, offering a more stringent legal framework to protect landowners and deter future land grabbing incidents.
The bill, approved by the Council of Ministers on Wednesday, comes in response to a surge in land grabbing cases across both urban and rural areas in recent years. This trend has been attributed to rapid urbanization, industrialization, and commercialization.
The 2024 Bill introduces several key changes, including:
* **Increased penalties:** The proposed legislation increases the minimum prison term for land grabbing to 10-14 years and aligns fines with the market value of the grabbed property. Additionally, any profits derived from the property must be returned to the rightful landowners by court order.
* **Dedicated Special Courts:** The bill establishes Special Courts with both civil and criminal jurisdiction to handle land-grabbing cases comprehensively. These courts will be presided over by experienced judges and will have the authority to develop their own procedures based on natural justice principles.
* **Streamlined Judicial Processes:** The Bill aims to expedite case resolutions with a mandate for cases to be concluded within six months. It also introduces dedicated public prosecutors for each Special Court, ensuring stronger representation for aggrieved landowners.
* **Enhanced Procedural Rigour:** District Collectors will authorize investigations, which will be handled by senior officers, ensuring thorough and fair investigations.
* **Shifted Burden of Proof:** The new legislation shifts the burden of proof onto the accused, with a presumption of land grabbing in cases where assets exceed legitimate income sources.
The Andhra Pradesh government believes that this new legislation will not only deter future land grabbing but also create a more secure environment for landowners. The bill is currently awaiting legislative approval.
