A class-action lawsuit filed Tuesday accuses Elon Musk and his America Pac organization of deceiving voters by falsely claiming winners of a $1 million daily giveaway were chosen at random. The suit, filed by Arizona resident Jacqueline McAferty, alleges Musk’s organization instead hand-picked the winners to act as spokespeople for the group.

McAferty, who signed the petition for a chance to win, claims she was misled by the promise of a random selection process. Musk’s own attorneys confirmed this, stating in court that the winners were pre-selected.

The suit also alleges that Musk’s organization profited from the giveaway by driving traffic to his X social media platform and collecting personal information from participants.

The lawsuit comes a day after a Philadelphia judge denied a request to end the giveaway, which was deemed an illegal lottery by the city’s district attorney. However, the ruling is largely symbolic as Musk has no further plans for the giveaway following the US presidential election.

The giveaway targeted voters in seven battleground states, offering $1 million to those who signed a petition supporting free speech and gun rights. The lawsuit seeks at least $5 million in damages for all participants.

Musk has openly supported Donald Trump in the presidential race and donated over $100 million to America Pac.
