**Washington, D.C. –** In a significant victory for independent creators, the US Patent and Trademark Office (USPTO) has canceled several trademarks related to the term “Super Hero” previously held jointly by comic giants Marvel and DC.
This decision stems from a challenge filed by Superbabies Limited, a company producing comics featuring superhero babies. The company, represented by the law firm Reichman Jorgensen Lehman & Feldberg (RJLF), argued that Marvel and DC’s claim to the trademarks was invalid, citing their inability to “claim ownership over an entire genre” and the fact that two competitors cannot co-own trademarks.
Marvel and DC failed to respond to the challenge by the July 24th, 2024 deadline, leading to the USPTO’s cancellation of four trademarks, including the oldest registered in 1967. The two companies still retain ownership of the “SUPER HEROES” trademark registered in 2018 and the “SUPER-VILLAIN” trademark secured in 1985.
