**LINCOLN, NE** – The Nebraska Supreme Court ruled on Friday that a ballot measure seeking to repeal a new law providing taxpayer money for private school tuition will appear on the November ballot. The court rejected arguments from supporters of the law that the measure illegally targeted a government appropriation.

The ruling comes after a contentious legal battle. The law, which went into effect earlier this year, allocates state funds directly to private school scholarships. Public school advocates successfully gathered enough signatures to put a repeal measure on the ballot, but supporters of the law argued that the referendum violated the state constitution.

The Supreme Court, however, found that the ballot measure targets the creation of the private school tuition program, not the appropriation itself, and therefore does not violate the state constitution.
