Thu Sep 12 06:06:45 UTC 2024: ## Supreme Court Upholds DOE Circular on Oil Price Transparency

The Supreme Court (SC) has ruled in favor of the Department of Energy (DOE) in a landmark decision regarding oil price transparency. The court upheld the validity of the DOE’s circular, requiring oil companies to disclose detailed information on price adjustments, including supporting documents.

The decision, released on September 10th, affirmed earlier rulings by the Court of Appeals (CA) which reversed a 2019 decision by the regional trial court. The case was initiated by a group of oil companies, including Philippine Institute of Petroleum, Inc. (PIP), Isla LPG Corporation, PTT Philippines Corporation, and Total Philippines, who challenged the DOE circular’s constitutionality.

The oil companies argued that the circular violated their rights, was contrary to the Downstream Oil Industry Deregulation Act of 1998 (RA 8479), and amounted to price control. They further claimed that the circular’s requirements were impossible to fulfill and violated their trade secrets.

However, the SC rejected these claims. In its decision, the court stated that the DOE circular does not impose price control or dictate market prices but merely seeks to ensure transparency and accountability in the oil industry. The court also noted that the oil companies failed to demonstrate any actual or substantial damage resulting from the circular’s implementation.

The SC’s decision reinforces the DOE’s mandate to monitor and regulate the downstream oil industry in order to protect consumers from unfair price increases and ensure a competitive market. It is expected to have a significant impact on the oil industry, requiring greater transparency and accountability in their pricing practices.
