The recent visit of Prime Minister Narendra Modi to Chief Justice of India DY Chandrachud’s residence for Ganpati puja has sparked a controversy, with some politicians questioning the CJI’s impartiality. Shiv Sena leader Sanjay Raut expressed his concern, citing the ongoing case regarding the Maharashtra political crisis where the PM is a party. He raised doubts about the judiciary’s ability to deliver justice in such a situation.
Senior advocate Indira Jaising echoed these concerns, claiming the meeting compromised the separation of powers between the executive and judiciary. She called for the Supreme Court Bar Association (SCBA) to take note of the incident.
However, the SCBA President, Kapil Sibal, defended CJI Chandrachud, highlighting his personal integrity. While acknowledging that publicizing a private event could be viewed negatively, Sibal expressed confidence in the CJI’s judgment.
The Bar Council of India Chairman, Manan Kumar Mishra, also asserted that the PM’s visit didn’t compromise the judiciary’s neutrality.
BJP leader BL Santosh countered the criticism, emphasizing the cordial relationship between the PM and the CJI, and arguing that their co-travelership in the nation’s journey shouldn’t be seen as suspicious. He also reminded the public that the PM had called the CJI during his Covid-19 infection, highlighting their professional relationship.
The controversy raises two key questions: does such a meeting blur the lines between the judiciary and the executive? And does the Opposition genuinely believe the CJI can be influenced so easily?
While some politicians, like Sanjay Raut, have attempted to link the PM’s visit to recent judgments in court cases, others, like Rajya Sabha MP Milind Deora, have labeled this a reckless attempt to undermine the CJI’s credibility.
It’s worth noting that CJI Chandrachud has previously delivered judgments adverse to the Modi government, such as the scrapping of the electoral bond scheme, further highlighting the independent nature of the judiciary.
The debate ultimately boils down to perception. While the PM and the CJI have met on numerous official occasions, the question remains: does a social or religious event compromise the neutrality of the judiciary?
This incident serves as a reminder of the delicate balance that exists between different branches of government and the importance of maintaining public trust in judicial independence.
