**NEW YORK, NY** – A federal jury in the trial of Sean “Diddy” Combs has informed the court that they have reached a verdict on four of the five counts against the hip-hop mogul, but remain deadlocked on the most serious charge: racketeering conspiracy (Count 1). Combs, 55, faces allegations of operating a criminal enterprise that coerced women into sexual encounters, often referred to as “Freak Offs.”
The jury has reached verdicts on Counts 2, 3, 4, and 5, which include two counts of sex trafficking and two counts of transportation for the purpose of prostitution. The racketeering conspiracy charge carries a potential life sentence, while the other counts have minimum sentences of 15 years and maximums of life in prison, or a maximum sentence of 10 years, respectively.
According to a note sent to Judge Arun Subramanian, the jury stated they have jurors with “unpersuadable opinions on both sides” regarding the racketeering charge. Both the prosecution and the defense have requested that the judge instruct the jury to continue deliberations.
Judge Subramanian is considering how to respond to the jury’s impasse. He is considering reading back to the jurors portions of his original instructions that remind them to continue to “consult with one another and to deliberate with a view to reaching an agreement,” but to not surrender their “honest convictions concerning the effect or weight of the evidence for the mere purpose of returning a verdict or solely because of the opinion of other jurors.”
An Allen charge, which would instruct jurors to re-examine their own views and opinions in order to reach a decision, was proposed by the government, but the defense considers it premature and would like more gentle language to encourage continued discussion.
CNN Senior Legal Analyst Elie Honig explained that the judge has two options: either send the jury back to continue deliberating on all counts, withholding the verdicts they have reached, or accept the verdicts on the four counts and then instruct them to resume deliberations solely on the racketeering conspiracy charge.
Combs, who was present in the courtroom with his legal team, appeared serious as he received the note from the jury. His mother and sister were also present. The jury has been deliberating for approximately 10 hours, sending multiple notes to the judge throughout the process. The content of these notes included requests for testimony transcripts from key witnesses, including Cassie Ventura and Daniel Phillip.
