**New Delhi, May 3, 2025** – The Supreme Court of India ruled today that a Tamil Nadu police constable, unjustly denied promotion, must be considered for the sub-inspector position. The court overturned a Madras High Court decision from October 2023 that dismissed the constable’s plea.
The constable, appointed in March 2002, was eligible for promotion in 2019 but was denied consideration due to a past disciplinary action. While he faced both departmental and criminal charges for allegedly assaulting a colleague, the criminal charges were dismissed, and the departmental punishment was rescinded in 2009. However, police authorities continued to deny his promotion citing the now-invalid punishment.
The Supreme Court clarified that while employees have no automatic right to promotion, they have a right to be considered unless explicitly disqualified. The court deemed the denial of consideration based on a revoked punishment unjust and ordered his immediate consideration for promotion retroactively to 2019, including back pay. The constable will be promoted if deemed eligible.
