**New Delhi, April 10, 2025** – The Allahabad High Court’s decision to grant bail to a rape accused has ignited widespread controversy. The court, in its March 11th ruling, controversially stated that the victim, a master’s student, was partly responsible for the assault.

According to the First Information Report (FIR), the victim alleged she was raped twice after accepting an invitation to rest at the accused’s home following a night of drinking with friends. She further claimed the accused touched her inappropriately. The accused, however, argued the encounter was consensual.

Justice Sanjay Kumar Singh, in granting bail, cited the victim’s own account, stating that even if her allegations were true, “she herself invited trouble and was also responsible for the same.” The court noted a torn hymen, but the medical report did not definitively conclude sexual assault. The accused’s lack of criminal history and prolonged pre-trial detention were also considered factors.
