Wed Mar 19 15:28:40 UTC 2025: ## Madurai High Court Upholds Dismissal of Divorce Appeal Based on Wife’s Private Pornography Consumption
**Madurai, India (March 19, 2025)** – The Madurai Bench of the Madras High Court dismissed an appeal for divorce, ruling that a wife’s private viewing of pornography and self-pleasure do not constitute cruelty towards her husband.
The appeal was filed by a man challenging a Karur Family Court’s decision. He claimed his wife suffered from a communicable venereal disease and exhibited cruel behavior, citing her pornography consumption and self-pleasure as evidence.
The High Court’s Division Bench, Justices G.R. Swaminathan and R. Poornima, noted the seriousness of the venereal disease allegation and the need for strict proof, emphasizing the right of the accused to demonstrate the condition wasn’t the result of immoral conduct. The court found the husband failed to provide sufficient evidence to support this claim.
Regarding the pornography and self-pleasure allegations, the judges stated that private pornography consumption (excluding statutorily prohibited content) is not an offense. While acknowledging potential impacts on psychological health, they clarified that this alone does not constitute cruelty towards a spouse. Furthermore, they deemed questioning a woman about self-pleasure a violation of her sexual autonomy and not grounds for divorce.
The court emphasized the importance of spousal privacy as an aspect of a woman’s fundamental right to privacy and individual expression. The husband’s failure to provide forensic evidence from his wife’s phone or evidence of neglected household chores further weakened his case.
The High Court upheld the Family Court’s decision, dismissing the appeal and affirming the marriage.
