**Los Angeles, CA –** The Los Angeles District Attorney, Nathan Hochman, announced Friday that a decision on whether Lyle and Erik Menendez will be resentenced for the 1996 murder conviction of their parents remains pending. A March hearing will address the proposed resentencing, which would make the brothers immediately eligible for parole.

Hochman, who replaced George Gascón in December, stated he will provide an update on his position in the coming weeks. Gascón had previously recommended a resentencing to 50 years to life. Hochman criticized this recommendation as a “desperate political move.”

The Menendez brothers were originally convicted of murdering their parents, Jose and Kitty Menendez, in 1989. Their bid for resentencing stems from new evidence alleging Jose Menendez sexually abused Erik. The brothers claim they acted in self-defense, fearing their parents would kill them to prevent disclosure of the abuse.

Hochman, however, expressed skepticism about the evidence of sexual abuse, stating in a news conference that it did not constitute self-defense. He filed an informal response to a 2023 habeas corpus petition urging the court to reject the brothers’ request for re-examination of the case. The resentencing hearing, initially scheduled for December, has been delayed twice, first to January and then to March 20 and 21 due to the Los Angeles wildfires.

Hochman is reviewing thousands of pages of prison records to assess the brothers’ rehabilitation. He has also met with their relatives. The case has gained renewed interest following the release of the Netflix true-crime drama, “Monsters: The Lyle and Erik Menendez Story.” The revelation that Roy Rossello, a former member of Menudo, accused Jose Menendez of drugging and raping him as a teenager further fuels the ongoing debate.
