**Los Angeles, CA** – Two Los Angeles County Deputy District Attorneys, Nancy Theberge and Brock Lunsford, are preparing to sue the District Attorney’s Office, alleging retaliation, defamation, and discrimination following their recommendation to resentence the Menendez brothers. The pair claim they were demoted and publicly disparaged after formally advocating for a reduced sentence for Lyle and Erik Menendez, who were convicted of murdering their parents in 1989.
The lawsuit alleges that newly elected District Attorney Nathan Hochman demoted both prosecutors shortly after taking office. Lunsford, a 25-year veteran, was transferred to a less prominent role, while Theberge was returned to her previous position at the public defender’s office despite positive performance reviews.
The prosecutors’ attorney, Justin Shegerian, claims their careers have been “totally derailed” due to the actions of Deputy District Attorney John Lewin, who allegedly compared them to Nazi collaborators, using the term “quislings,” and accused Theberge of compromising her integrity. These accusations, according to Shegerian, were made in interviews and on social media.
Theberge and Lunsford’s recommendation for resentencing came while former DA George Gascón was considering the matter, following the emergence of new evidence suggesting the brothers suffered childhood sexual abuse. Hochman, who campaigned on a tough-on-crime platform, reversed Gascón’s more lenient approach after winning the election.
The District Attorney’s Office has yet to respond to requests for comment. This legal action is the latest development in the ongoing saga surrounding the Menendez brothers, whose case has recently gained renewed public attention due to a Netflix documentary and television series. A scheduled court hearing on the resentencing has been postponed to late March due to recent wildfires in Los Angeles.
