Wed Jan 22 15:33:07 UTC 2025: ## Karnataka High Court Rejects Plea for Matrimonial Case Transfer, Emphasizes Gender-Neutral Approach
**Bengaluru, January 22, 2025** – The Karnataka High Court has rejected a woman’s petition to transfer a matrimonial case, highlighting the need for a gender-neutral approach to legal proceedings. Justice Chillakur Sumalatha ruled that while women often face hardship, equal rights extend to both genders, and convenience should not be determined solely based on sex.
The case involved a woman from Hosanagar taluk seeking the transfer of her husband’s divorce petition from a court in N.R. Pura taluk to her hometown. The court found that transferring the case would cause greater inconvenience to the husband, who is caring for their two children, aged nine and seven. The court noted that the husband’s responsibilities include preparing meals, ensuring the children attend school, and attending court proceedings, making a transfer impractical.
Justice Sumalatha emphasized that a gender-neutral society necessitates equal treatment for men and women in both domestic and professional settings. The court rejected the petition, stating that all relevant circumstances must be considered, not just the petitioner’s gender. The judge’s decision underscores the court’s commitment to fairness and equitable treatment regardless of gender.
