Instead of appealing to the Administrative Tribunal of Sport (TAD), Barcelona will directly petition the Higher Council for Sport (CSD) for a provisional injunction. This fast-track approach is necessitated by tight deadlines; the appeal cannot be submitted until Tuesday, January 7th.

The club’s argument centers on “force majeure,” citing the late arrival of a €28 million payment from an investor related to the future Spotify Camp Nou’s VIP seating rights. This payment, crucial for meeting registration requirements, was not received by the December 31st deadline. Barcelona maintains this delay justifies their inability to meet the registration deadline, referring to article 130.2 of the RFEF General Regulations.

The outcome will significantly impact Barcelona’s participation in the Supercopa de España. A swift, favorable ruling from the CSD could allow Olmo and Víctor to play in the semi-final against Athletic Club on Wednesday, January 8th. However, a decision may not be reached before the potential final on January 12th.

Failure to secure a favorable ruling from the CSD would leave Barcelona with a final recourse to the ordinary courts (Tribunal Contencioso Administrativo) before the winter transfer window closes on February 3rd. The players could theoretically terminate their contracts 24 hours before the deadline, resulting in significant sporting, economic, and reputational damage for the club.
