Thu Jan 02 14:41:34 UTC 2025: ## Madurai High Court Fines Petitioner ₹50,000 for Frivolous Lawsuit

**Madurai, January 2, 2025** – The Madurai Bench of the Madras High Court today dismissed a petition seeking the cancellation of land ownership documents (patta) granted to four individuals, fining the petitioner ₹50,000 for what it deemed a frivolous lawsuit.

Swaminathan, the petitioner from Dindigul district, claimed the land in Sengurichi belonged to a temple and that the patta was fraudulently obtained. The court, however, ruled that the petitioner failed to provide sufficient evidence to overturn the presumption of validity under the Tamil Nadu Patta Passbook Act, 1983.

Justices M.S. Ramesh and A.D. Maria Clete noted that Swaminathan had filed the petition as a public interest litigation (PIL) without making the four individuals named in the patta parties to the case. The court deemed this a procedural flaw and further criticized the petitioner for simultaneously pursuing administrative channels to cancel the patta while filing the PIL. The judges concluded that the petition lacked a genuine public interest motive and was filed with an “ulterior motive.” The court therefore dismissed the petition and imposed the fine.
