Sun Dec 08 14:09:00 UTC 2024: ## Bengaluru Police Appeals High Court Acquittal in 2012 Terror Case
**Bengaluru, [Date]** – The Bengaluru Police have appealed to the Supreme Court against a Karnataka High Court decision that acquitted three individuals, including a Pakistani national, in a 2012 terror case. The High Court, on September 25th, exonerated Syed Abdul Rahman (36), Apsar Pasha (43), and Pakistani national Mohammad Fahad alias Mohammad Koya (42) of charges under the Unlawful Activities (Prevention) Act, Indian Penal Code, Arms Act, and Explosives Substances Act.
The High Court overturned a lower court’s conviction, citing insufficient evidence to prove a criminal conspiracy. The lower court had sentenced the trio to life imprisonment based on evidence presented by the Bengaluru Police’s Central Crime Branch. The High Court’s ruling hinged on the jail superintendent’s testimony that phone usage was prohibited within the prison, undermining the prosecution’s claim that Fahad and Pasha had instigated Rahman to terrorist activities while incarcerated.
The Bengaluru Police had alleged that Fahad and Pasha, while in contact with Rahman via phone calls, had encouraged his involvement in terrorism and facilitated his acquisition of weapons and explosives through contacts abroad. Following the acquittal, Fahad was ordered deported. The police appeal to the Supreme Court aims to overturn the acquittal and potentially prevent Fahad’s deportation. The case involves allegations of Lashkar-e-Taiba links.
