NEW DELHI (December 4, 2024) – The Delhi High Court granted activist Nadeem Khan interim protection from arrest until December 6th in a case alleging he promoted enmity. The Delhi Police filed an FIR against Mr. Khan, national secretary of the Association for Protection of Civil Rights, on November 30th, citing a video they claimed could incite violence.

Justice Jasmeet Singh expressed skepticism about the police’s claims, stating that the country’s harmony and its citizens’ understanding are not so easily swayed. The court emphasized the importance of protecting fundamental rights, particularly Article 19(1)(a) (freedom of speech and expression).

Mr. Khan’s lawyer, senior advocate Kapil Sibal, argued the FIR lacked evidence of a cognizable offense. The police countered, alleging Mr. Khan was attempting to incite conflict.

The court issued a notice to the police regarding Mr. Khan’s plea to quash the FIR and ordered him to cooperate with the investigation while remaining in Delhi. The interim protection from arrest remains in effect until the next hearing on December 6th.
