**Los Angeles, CA** – The resentencing hearing for Lyle and Erik Menendez, convicted in 1996 for the murder of their parents, has been postponed until January 30th. The delay, announced Monday by Los Angeles Superior Court Judge Michael Jesic, allows the incoming District Attorney, Nathan Hochman, time to review the case.
Hochman, who replaces George Gascón (who lost his reelection bid), will assess Gascón’s October recommendation for resentencing the brothers, a move that could lead to their release after nearly 34 years in prison. Gascón’s recommendation was based on new evidence, including allegations of abuse by their father, Jose Menendez, revealed in a recent Peacock docuseries and a previously undisclosed letter from Erik Menendez detailing the abuse.
Monday’s hearing, the brothers’ first court appearance since their conviction, was closed to cameras. However, sisters of both Jose and Kitty Menendez testified in support of resentencing, stating their belief that the brothers had served sufficient time and highlighting the years of abuse they suffered.
While the Menendez brothers have admitted to the killings, they claim self-defense, citing the alleged abuse. Prosecutors maintained the murders were premeditated and financially motivated. The case has garnered renewed public interest due to recent documentaries and renewed discussions around the impact of childhood trauma.
Hochman has stated his commitment to a thorough review, emphasizing the importance of fairness to all parties involved. The brothers’ release remains uncertain, pending Hochman’s decision. A separate clemency petition, also supported by Gascón, is on hold until Hochman completes his review.
