**NEW DELHI** – The Supreme Court of India granted anticipatory bail to Malayalam actor Siddique on November 19th in a rape case filed against him by a young actress. The decision comes after a lengthy legal battle marked by significant delays and conflicting arguments.

The complainant alleged that Siddique raped her in 2016, but she did not file a formal complaint until August 2024. She had, however, mentioned the allegations on Facebook in 2018, naming Siddique and several other individuals from the Malayalam film industry.

Siddique’s legal team, led by Senior Advocate Mukul Rohatgi, argued that the eight-year delay in filing the complaint cast doubt on its veracity, pointing to inconsistencies in the complainant’s narrative and her failure to report the incident to the police or the Justice Hema Committee, a body established to address sexual harassment complaints within the industry. They also highlighted a recent complaint filed by Siddique against the complainant, suggesting a possible personal conflict. The defense also claimed that Siddique cooperated fully with police investigations until October 12, 2024.

The complainant’s lawyer, Advocate Vrinda Grover, countered that the delay was due to societal and systemic pressures faced by survivors of sexual assault. She highlighted the release of the Justice Hema Committee report in August 2024 as a catalyst for the complainant to finally file a formal complaint. Grover detailed the alleged grooming process leading to the incident, stating that Siddique invited the complainant to a film preview where the alleged rape took place.

The Supreme Court, while acknowledging the sensitivity of the case, granted anticipatory bail, citing the delay in filing the complaint and the complainant’s actions on social media. However, the court imposed conditions, including the surrender of Siddique’s passport and full cooperation with the ongoing investigation. The trial court was also given the authority to impose additional conditions.
