Tue Nov 19 01:30:00 UTC 2024: **Karnataka High Court Slams BBMP for Flip-Flop on Garbage Plant TDR**

**Bengaluru, November 19, 2024** – The Karnataka High Court has sharply criticized the Bruhat Bengaluru Mahanagara Palike (BBMP) for its contradictory stance regarding Transferable Development Rights (TDR) granted for land acquisition related to a garbage treatment plant. Dismissing a public interest litigation (PIL) filed by BJP leader N.R. Ramesh, the court levied a ₹10,000 cost.

The court found the BBMP’s arguments opposing the TDR grant to be directly contrary to the State government’s position, raising concerns about a possible collusive attempt to misuse the court’s jurisdiction. The court noted that the proposal for the plant originated with the BBMP itself.

The Bench also questioned Ramesh’s motives, citing his 11-year delay in filing the petition and his prior role as a BBMP councilor during which he did not raise objections. The court deemed this a significant indicator of a lack of good faith.

The PIL alleged that the 2013 land acquisition in Kodiyala Karenahalli village for the plant, along with the subsequent issuance of TDR, unjustly benefited private individuals and developers at the expense of public funds. However, the court dismissed these claims, citing the BBMP’s inconsistent and suspicious behavior.
