The Supreme Court on Friday delivered a landmark judgment on the long-standing controversy surrounding the minority status of Aligarh Muslim University (AMU). A seven-judge constitutional bench, divided in its opinion, ultimately ruled that the 1967 judgment removing AMU’s minority status should be revoked.
The court’s decision was split 4:3, with Chief Justice D.Y. Chandrachud leading the majority opinion. However, the court did not definitively grant AMU minority status, instead, referring the matter to another bench for final determination.
Justices Surya Kant, Dipankar Datta, and S.C. Sharma dissented, arguing against granting minority status to AMU. Chief Justice Chandrachud, along with Justices Sanjiv Khanna, J.B. Pardiwala, and Manoj Misra, favored the reinstatement of AMU’s minority status.
The court’s decision is a significant victory for AMU, which has long argued that it was founded as a Muslim minority institution and should be recognized as such. The debate over its minority status has been ongoing for decades, with the university facing challenges in maintaining its autonomy and preserving its character.
While the final decision on AMU’s minority status remains pending, the Supreme Court’s ruling is a major step towards resolving this complex issue. It remains to be seen how the next bench will rule on the matter and what impact this will have on AMU’s future.
