A Republican-led House subcommittee has referred former New York Governor Andrew Cuomo to the Justice Department for potential prosecution, accusing him of lying to Congress about his involvement in a state Covid report on nursing home deaths.

The referral, signed by Republican Representative Brad Wenstrup, alleges that Mr. Cuomo engaged in a “conscious, calculated effort” to avoid accountability for his handling of nursing homes during the pandemic. It centers on closed-door testimony where Mr. Cuomo claimed he did not review a State Health Department report that attempted to deflect blame for deaths in nursing homes. However, a New York Times investigation later revealed that Mr. Cuomo had reviewed the report and even personally wrote parts of early drafts.

While Mr. Cuomo’s spokesperson maintains that he testified truthfully and simply did not remember his role in the report, the referral suggests that the Justice Department investigate potential “false statements” made by the former governor. Notably, no other committee member, including the ranking Democrat, signed the referral letter, highlighting the potential for political partisanship in the decision.
