**The Hague, Netherlands** – Israel has formally challenged the International Criminal Court’s (ICC) request for arrest warrants for Prime Minister Benjamin Netanyahu and Defence Minister Yoav Gallant, alleging crimes committed during the recent war in Gaza.
The ICC prosecutor, Karim Khan, had sought the warrants in May, alongside similar requests for Hamas leaders, including Mohammed Deif, Yahya Sinwar, and the late Ismail Haniyeh. The warrants allege war crimes and crimes against humanity, including “causing extermination, causing starvation as a method of war, and deliberately targeting civilians,” according to Khan.
Israel, which does not recognize the ICC, argues that the court lacks jurisdiction and that Israel has the right to investigate the allegations itself. The Israeli government submitted two legal briefs, challenging both the court’s jurisdiction and the prosecutor’s process, stating that “no other democracy with an independent and respected legal system like that which exists in Israel has been treated in this prejudicial manner by the Prosecutor.”
The ICC’s decision to pursue the warrants has already caused considerable international controversy. While the United States has condemned the request, Germany has stated it would honor the warrants if issued. The UK’s position remains less clear, with the current government expressing concern about the potential political fallout.
The ICC’s investigation into the conflict in Gaza is separate from a separate genocide case against Israel brought by South Africa to the International Court of Justice. If the arrest warrants are granted, it would create significant diplomatic challenges for Israel’s allies that are members of the ICC.
The ICC’s authority was recently tested when Russian President Vladimir Putin visited Mongolia, an ICC member state, despite an outstanding warrant for his arrest for war crimes in Ukraine. The outcome of this challenge to the ICC’s authority on Netanyahu and Gallant remains to be seen.
