High street retailer Next has issued a warning that it may be forced to close stores if its appeal against a landmark equal pay ruling fails. In August, an employment tribunal ruled that 3,500 predominantly female shop staff were discriminated against by being paid less than their mostly male colleagues in warehouses.
While Next has announced a record profit forecast of nearly £1bn for the current year, the company acknowledges that upholding the ruling could lead to significant financial strain. The potential payout to 3,500 current and former workers could exceed £30m.
Next has already confirmed its intent to appeal the ruling, arguing that warehouse workers are paid more in the wider labor market. Despite expressing confidence in its grounds for appeal, the retailer admitted that a loss could impact its financial position and operational costs.
The company emphasizes the individual profitability of each store, stating that stores must remain profitable to both open and continue trading.
Despite this potential challenge, Next’s overall performance remains strong. Sales rose by 8% to £2.9bn in the first half of its financial year, while pre-tax profits increased by 7.1% to £452m. The company attributed its strong performance to increased overseas sales driven by the popularity of international fashion trends promoted by platforms like Netflix, Amazon Prime, and TikTok.
Next also reported significant growth in the Americas, where sales jumped by 67%. Meanwhile, UK sales of its own-branded clothing fell by 0.9%, attributed to a cooler summer compared to the previous year.
Despite the strong performance and future outlook, the potential financial implications of the equal pay ruling pose a significant challenge for Next. The outcome of the appeal will have a major impact on the future of the retailer and its network of stores.
