The Bombay High Court has directed the Central Board of Film Certification (CBFC) to make a decision on the release of Kangana Ranaut’s upcoming film “Emergency” by Wednesday. The court expressed its dissatisfaction with the CBFC’s delay in issuing a censor certificate, highlighting the need to protect creative freedom and freedom of expression.
The film, which features Kangana Ranaut, Anupam Kher, and Shreyas Talpade, depicts the Emergency period imposed by Indira Gandhi’s government in 1975. It has faced opposition from Sikh organizations who claim the film misrepresents their community. The CBFC, citing concerns about “sensitive content” and allegations of factually inaccurate depictions, had initially proposed a review by a revising committee, requesting a two-week delay.
The court, however, rejected this request, asserting that the CBFC must take a firm decision on the film’s release. The court criticized the CBFC’s “sitting on the fence” approach and stressed the need to stop the trend of objecting to film releases.
The high court also raised questions about the political implications surrounding the film’s censorship. The court pointed out the producer’s affiliation with the ruling party and questioned the CBFC’s reasoning for potentially blocking the release of a film by a member of their own party.
The court’s decision comes after the Madhya Pradesh High Court dismissed a petition against the film earlier this month, citing the absence of a censor certificate. Zee Entertainment Enterprises, the co-producer of “Emergency,” then appealed to the Bombay High Court, demanding the release of the censor certificate. The court’s order now forces the CBFC to make a definitive decision on the film’s fate.
