**Ballarat, Victoria** – A 66-year-old diabetic man, William Swale, has been acquitted of all charges related to a fatal car crash that killed five people, including two children, at a Daylesford beer garden last November.

Swale was driving his BMW SUV when it crashed into patrons outside the Royal Daylesford Hotel. The victims were identified as Pratibha Sharma (44), her daughter Anvi (9), and partner Jatin Kumar (30), and their friends Vivek Bhatia (38) and his son Vihaan (11).

Swale, who was diagnosed with type 1 diabetes in 1994, claimed he suffered a severe hypoglycemic attack while driving, rendering him unconscious at the time of the crash.

Despite evidence from diabetes experts, police, paramedics, and a witness who found Swale “wasted” behind the wheel moments after the crash, Magistrate Guillaume Bailin ruled that the prosecution case was flawed and did not provide sufficient evidence for a conviction.

Bailin was critical of the Crown’s framing of the case, arguing that it failed to establish whether Swale’s actions were voluntary from 5.36pm, the time the Crown claimed his negligence period began. He concluded that Swale was suffering a severe hypoglycemic episode at that time, making his actions involuntary.

The magistrate acknowledged the difficult nature of the case for the families of the victims, who attended court daily but whose names were not mentioned during proceedings. He expressed his sympathy for their loss and commended them for their dignified conduct throughout the process.

While Swale walked free from court, the decision has left many questioning the legal ramifications of driving while suffering from a medical condition that can lead to unconsciousness. The tragedy highlights the complex interplay of medical conditions, personal responsibility, and the legal system in such cases.
