**MANILA, PHILIPPINES** – Several members of the House of Representatives have called on the Commission on Elections (Comelec) to reconsider a resolution allowing government officials to stay in their posts even after accepting party-list nominations.

During budget deliberations, Basilan Rep. Mujiv Hataman expressed concern that the rule gives an unfair advantage to incumbent officials, potentially allowing them to use their influence to sway voters. “Elections should be fair. There should be no advantage or misuse of government power to influence the outcome,” he stated.

The Comelec’s resolution, however, argues that party-lists are elected as a group, not based on individual nominees. Despite this, Hataman countered that it is ultimately the nominated individual who will take the seat in the House of Representatives, raising concerns about the potential for misuse of power.

Northern Samar Rep. Paul Daza went further, calling the resolution “suspicious” and alleging a violation of the Philippine Constitution. He cited Article 9, Section 2, which prohibits civil servants from engaging in partisan political campaigns. Daza believes the resolution will lead to many incumbent officials seeking party-list seats, giving them an unfair advantage.

Election lawyer Romulo Macalintal has already filed a petition with the Supreme Court to nullify the Comelec’s rule. The Comelec has stated that they will wait for the Supreme Court’s decision on the matter.

The controversy highlights a growing concern about the potential for misuse of power during elections. The outcome of the Supreme Court’s ruling will have a significant impact on the fairness and integrity of the upcoming elections.
