Experts have expressed concerns that Roberts’ decision to take over the opinion may have been motivated by the negative optics surrounding the flag incident. The Fischer case, which ultimately narrowed the definition of “obstructing an official proceeding,” has been reexamined due to the court’s ruling.
“It seems Roberts seized the J6 case from Alito to avoid bad optics,” said Mark Joseph Stern, a senior writer for Slate. “Which is so damning—if Alito couldn’t *write* the opinion, he obviously needed to recuse himself.”
