**Aurora, CO** – A Colorado judge has sparked controversy by vacating the five-year prison sentence of former paramedic Peter Cichuniec, who was convicted in the death of Elijah McClain. Judge Mark Warner, over the objection of prosecutors, instead sentenced Cichuniec to four years of probation.
Cichuniec, 51, was found guilty of criminally negligent homicide and second-degree assault in March. He was charged with assisting in the administration of a fatal dose of ketamine to McClain, a 23-year-old Black man who was stopped by police while walking home in 2019.
Prosecutors argued that vacating the sentence undermines the judicial process and the jury’s verdict. They emphasized that Cichuniec supervised the paramedic who injected McClain with ketamine, a drug the jury determined was administered without McClain’s consent and without legitimate medical reason.
