**New Delhi, India -** India’s Competition Commission of India (CCI) is poised to impose penalties on global e-commerce giant Amazon for alleged violations of competition law. This action comes under the purview of stricter regulations that allow penalties based on a company’s global turnover.

The investigation wing of the CCI has confirmed charges of anti-competitive behavior against Amazon Seller Services Pvt. Ltd. Following this confirmation, the CCI will soon issue a formal notice to Amazon, paving the way for a final order and potential penalties.

The Director General of Investigation (DG) attached to the CCI recently submitted a report substantiating the charges. The CCI is now in the process of communicating these findings to Amazon, offering the company an opportunity to be heard before issuing a final order.

The penalty, to be decided under the amended competition law, could reach up to 10% of Amazon’s global turnover.

This investigation was triggered by a complaint filed by a Delhi-based trade association in January 2020. The CCI subsequently ordered a probe into whether Amazon engaged in practices that favored certain sellers, provided preferential treatment to select businesses, and engaged in discounting practices that stifled competition in the market.

Experts believe that while the potential for high penalties serves as a deterrent against anti-competitive practices, the CCI must exercise caution in applying them, reserving them for egregious violations. Overuse could hinder market dynamism and innovation, discouraging companies from engaging in fair competition.

Similar investigations are ongoing against Flipkart Internet Pvt. Ltd., another major e-commerce player in India.

The final order from the CCI, with its associated penalties, will have a significant impact on the e-commerce landscape in India and serve as a precedent for future enforcement of competition law.
