Fri Sep 13 11:46:58 UTC 2024: ## Delhi CM Kejriwal Granted Bail by Supreme Court, Faces Restrictions

The Supreme Court granted bail to Delhi Chief Minister Arvind Kejriwal on Friday, September 13, in connection with the CBI’s complaint in the Delhi excise policy case. However, the court imposed conditions similar to those set for his bail in the Enforcement Directorate case.

While reiterating the previous conditions requiring a bail bond of Rs. 50,000, the court prohibited Kejriwal from making public comments about the CBI case, demanded his presence at every trial court hearing, and instructed full cooperation with the court to expedite the trial.

**Controversial Bail Conditions**

The court also restricted Kejriwal from visiting the Chief Minister’s Office and the Delhi Secretariat, and from signing official files unless “required and necessary” for obtaining the Delhi L-G’s approval. Justice Bhuyan expressed reservations about these two conditions but refrained from further comment.

**Impact on Kejriwal’s Powers**

While Aam Aadmi Party officials believe these restrictions will not significantly hamper Kejriwal’s governance, they acknowledge he cannot physically go to the Secretariat. They argue that Cabinet meetings can be conducted through file circulation, allowing files to be signed by the CM and sent to the L-G.

The condition regarding file signing is considered less impactful due to the unique position of the NCT of Delhi. The L-G has significant power, requiring his approval for most decisions, including those requiring the CM’s signature. This scheme of things, however, remains contentious, as seen in August 2022 when the L-G sent back 47 files to the CM’s office for personal signature.

**Ongoing Political Tensions**

The bail conditions and their implications continue to be a point of contention in the ongoing political battles between the BJP and AAP. While the court’s decision aims to ensure a fair trial, the restrictions on Kejriwal raise questions about his ability to effectively govern while facing these legal challenges.
