[City, State] – Kilmar Abrego Garcia, an El Salvadoran illegal immigrant previously embroiled in controversy over his deportation and alleged ties to MS-13, is back in the spotlight after posting a TikTok video following his release from federal immigration custody. The video has sparked outrage from Department of Homeland Security (DHS) Assistant Secretary Tricia McLaughlin, who criticized Garcia while acknowledging the department is restricted by a court-imposed gag order.
Garcia’s case gained national attention when he was mistakenly deported to El Salvador in March 2024, despite a 2019 court order. Upon his return to the U.S., he was detained on human smuggling charges stemming from a 2022 traffic stop. Garcia denies the allegations of MS-13 membership.
“So we, at [DHS], are under gag order by an activist judge and Kilmar Abrego Garcia is making TikToks,” McLaughlin wrote. “American justice ceases to function when its arbiters silence law enforcement and give megaphones to those who oppose our legal system.”
An Obama-appointed federal judge had previously issued an order restricting DHS and former Trump administration officials from publicly discussing Garcia’s case, which was later narrowed, following arguments that the officials’ remarks threatened his right to a fair trial.
A federal judge recently canceled Garcia’s trial and scheduled a hearing to review the prosecutors’ handling of the human smuggling charges, considering claims of vindictiveness. U.S. District Judge Paula Xinis has also extended a temporary restraining order, preventing the Trump administration from immediately re-detaining Garcia after the failure to produce a final removal order. This ruling has kept in place the earlier order securing his release from ICE custody.
