Delhi High Court Quashes Arrest Warrant Against UK Entrepreneur in Videocon Case

New Delhi – December 25, 2025 – The Delhi High Court has overturned non-bailable warrants issued against Sachin Dev Duggal, a UK-based entrepreneur, in connection with an Enforcement Directorate (ED) money laundering investigation linked to the Videocon group. The ruling, delivered on December 19th, stated that the legal prerequisites for issuing such warrants were not met in this case.

The court emphasized that while non-bailable warrants can be issued against individuals evading investigation, even if they are not formally accused, they must be presented as someone accused of a non-bailable offense and actively avoiding arrest.

In this instance, the court noted that Mr. Duggal’s status in the investigation was that of a “witness,” rendering the special court’s February 2023 decision to issue warrants outside the scope of Section 73 of the Criminal Procedure Code (CrPC).

The High Court further clarified that Section 73 of the CrPC, which grants the court power to issue NBWs, requires that the person in question be either a convict, a proclaimed offender, or accused of a non-bailable offense and evading arrest. “In the present case… it is not the case of the respondent that the petitioner at any point of time was an accused in the investigation or he was evading arrest,” the court stated.

The order effectively quashes the warrants issued by a special court earlier in the year. The investigation into the Videocon group and alleged money laundering activities continues.
