LOS ANGELES, CA – A bizarre and largely unreported legal battle between a gamer and video game company Aspyr, over the canceled “Restored Content DLC” for the Nintendo Switch version of Star Wars Knights of the Old Republic II, has finally concluded with a settlement. The dispute stemmed from Aspyr’s decision to scrap the promised DLC, which was initially advertised in a pre-release trailer.
Adding a layer of unusual drama to the proceedings, the gamer’s lawyer, Ray Kim, quoted rapper Lil Wayne in a legal filing. Responding to Aspyr’s attempts to sanction him and have the lawsuit withdrawn, Kim stated, “Okay, you’re a goon, but what’s a goon to a Goblin?? Nothin. Nothin. You ain’t scaring nothing.” He then clarified that Aspyr and its legal team were the “goons,” while he and his client were the “goblins,” determined not to be deterred.
The lawsuit, which began two and a half years ago, also uncovered a trove of internal communications that shed light on why the DLC was ultimately cancelled. It was revealed that Disney/Lucasfilm Games played a significant role in blocking the DLC, despite initial attempts by Aspyr to develop it.
Throughout the legal proceedings, Aspyr’s lawyers argued that the DLC tease wasn’t widely seen, that one of the gamers was too focused on “justice,” and that the free fan-made mod the DLC was based on had “no economic value.” They also initially masked Disney’s involvement in the cancellation.
While details of the settlement remain undisclosed, the case raised questions about the legal liability of game companies for unfulfilled promises made in pre-release trailers.
