The Hague – Belgium has formally joined the International Court of Justice (ICJ) case brought by South Africa accusing Israel of committing genocide in the Gaza Strip. The ICJ, the United Nations’ highest court, announced Belgium’s declaration of intervention on Tuesday, adding to the growing international support for the case.
Belgium joins a list of nations including Brazil, Colombia, Ireland, Mexico, Spain, and Türkiye who have already formally backed the proceedings. South Africa initiated the case in December 2023, arguing that Israel’s military actions in Gaza violate the 1948 UN Genocide Convention.
While Israel has vehemently denied the allegations, the ICJ issued provisional measures in January 2024 ordering Israel to take steps to prevent genocidal acts in Gaza and ensure humanitarian aid access. These orders are legally binding, though the court lacks a direct enforcement mechanism. The ICJ has also deemed Israel’s presence in occupied Palestinian territory unlawful.
Despite these rulings and increasing international condemnation, Israel has continued its military operations in Gaza and the West Bank, while also pushing forward plans to seize more Palestinian territory. The United States and some European allies continue to provide Israel with military and financial support. Washington has dismissed the merits of South Africa’s case and even sanctioned members of the International Criminal Court (ICC) who issued arrest warrants for Israeli leaders.
This move by Belgium comes after the country recognized the State of Palestine in September, aligning itself with nearly 80% of UN member states. The ongoing conflict in Gaza has resulted in a devastating toll, with the Palestinian Ministry of Health reporting over 70,000 Palestinians killed and over 170,000 wounded since the start of the war on October 7, 2023.
