New Delhi, December 17, 2025 – Apple Inc. is challenging the Competition Commission of India (CCI)’s power to impose penalties based on a company’s global turnover in the Delhi High Court. The court, on Tuesday, directed the Centre and the CCI to respond to Apple’s petition, which also contests the CCI’s demand for several years’ worth of audited financial statements.

Apple argues that amendments to the Competition Act, 2002, could result in significantly higher penalties. They claim that the CCI now has the authority to consider global turnover, even from territories outside India, when calculating penalties for anti-competitive practices. Apple estimates its potential maximum penalty exposure under the amended provisions to be approximately $38 billion.

The Alliance of Digital India Foundation, the original complainant in the case, has filed an application to be included as a party. The court has given all parties four weeks to file any objections to the application. The case is scheduled for further hearing on January 27, 2026.
