Lawyers Denounce Impeachment Move Against Madras High Court Justice as Attack on Judiciary
MADURAI, INDIA – December 13, 2025 – A group of senior advocates and lawyers practicing before the Madurai Bench of the Madras High Court have strongly condemned the notice to move a motion of impeachment against Justice G.R. Swaminathan, calling it “baseless” and a dangerous overreach by the legislature.
In a memorandum submitted to the Lok Sabha Speaker and released to the media today, the lawyers argue that the impeachment attempt is a direct attack on the independence and stability of the judiciary, representing a “brazen breach and misuse of Constitutional powers” by a section of Members of Parliament.
The memorandum pointedly states that the MPs involved appear to lack faith in the principles of democracy and the Constitution. It asserts that their action reflects “sheer bigotry and vested interests opposed to the national interest” and undermines the vital separation of powers.
While avoiding specific discussion of the case prompting the impeachment move due to ongoing appeal proceedings, the lawyers highlight Justice Swaminathan’s exceptional record of impartiality, honesty, and integrity. They emphasized his disposal of over 126,000 cases over eight years.
The memorandum urges the Lok Sabha Speaker to reject the impeachment motion outright, citing Articles 124(4) and 217 of the Constitution of India, read with the Judges (Inquiry) Act, 1968, as the basis for dismissal. They call on the Speaker to uphold the majesty of the law and protect the integrity of the judiciary.
