HARRIS COUNTY, Texas – Harris County Constable Precinct 4 is facing criticism for its social media practices after a local defense attorney claims the office continues to post photos of his client despite a judge dismissing the DWI case.
Criminal defense attorney Michael Stoll says Precinct 4’s Facebook page, known for its frequent updates on law enforcement activity, featured two posts showcasing his client being arrested and undergoing field sobriety tests. Stoll argues that the posts, made on December 6th and again in a roundup of recent DWI arrests, lacked disclaimers regarding the presumption of innocence and presented his client as a “drunk driver” without proper context.
“There was no language that he was charged for DWI for allegedly violating the law,” Stoll stated. “It was just here’s a drunk driver we pulled off the road.”
The case was ultimately dismissed by a judge due to a lack of probable cause, according to court records. Despite Stoll’s attempts to have the posts removed, including commenting directly on the Facebook post, the images remain public.
Stoll fears the lasting impact of these posts on his client’s reputation. “These posts will live on forever, and when you have a client whose case has been dismissed…it will pop up, and there is no explanation our clients can give other than the fact that it was dismissed,” he explained.
Fellow criminal defense attorney Jonathan White echoed Stoll’s concerns, emphasizing the “public shaming aspect” of posting identifiable information and images before a conviction.
ABC13 reached out to Precinct 4 for comment. The office stated that it is unable to monitor all social media comments and was unaware of the request to remove the post. While Stoll spoke with Precinct 4 today, the office told ABC13 it’s uncertain if the post will be removed and that the case has been refiled. The Constable’s Office has not commented further on the social media policy.
